Terms of Service
1. About AI PowerKit
AI PowerKit ("the Toolkit") is a licensed digital product that provides structures,
templates, dashboards and guidance for project management in engineering, construction and
consultancy environments. AI PowerKit is not a software-as-a-service platform by itself, but a
downloadable toolkit that you install, adapt and use within your own environment.
By purchasing, activating or using AI PowerKit, you ("you", "the Customer",
"the Licensee") agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you must not use the Toolkit.
2. Nature of the Toolkit – No Legal, Engineering or Financial Advice
AI PowerKit provides generic frameworks and draft-level structures intended to support your
own professional work. The Toolkit does not provide, and must not be treated as:
- legal advice or legal services,
- engineering, design, architectural or technical approvals,
- financial, tax or investment advice, or
- any form of official or regulatory documentation ready for submission to authorities.
You remain solely responsible for all decisions, calculations, judgments, contracts and
documents that you produce, adapt or deliver using the Toolkit.
3. Responsibility for the Final Documents
The Toolkit intentionally delivers draft-level, generic content. It is designed
to be a starting point that you customise, review and validate for each specific project.
You acknowledge and agree that:
-
All final versions of documents generated, edited or inspired by AI PowerKit are your
exclusive responsibility as the final Customer. -
You must review, correct, adapt and validate every document before using it with clients,
contractors, partners, authorities or other third parties. -
AI PowerKit does not validate the accuracy, completeness or correctness of any data,
assumptions, calculations or conclusions contained in your final documents.
4. References to Standards, Codes and Regulations
Any references in the Toolkit to standards, norms, codes, guidelines, best practices or
regulations (collectively "Standards") are provided for illustrative and educational
purposes only. They:
- are not guaranteed to be complete, up to date or applicable to your jurisdiction,
- must not be relied upon as a definitive list of all applicable requirements, and
- do not replace your duty to verify relevant Standards for each project and location.
It is exclusively your obligation to:
- identify all applicable laws, regulations, codes and standards for each project,
- check that your final documents comply with those requirements, and
- seek professional advice where needed (e.g. legal, regulatory, engineering).
5. Use of AI Assistants
AI PowerKit may include suggested workflows, prompts or examples for using third-party AI
assistants (including but not limited to large language models and other AI tools).
These suggestions are intended to:
- help you structure your prompts and review loops, and
- encourage human oversight and professional judgment.
You understand and agree that:
-
All AI-generated content must be treated as unverified draft material that requires human
review and correction. -
You are responsible for any confidential, personal or sensitive data that you choose to
share with external AI systems, and you must respect applicable privacy and confidentiality
obligations. - AI PowerKit is not responsible for the outputs of any third-party AI system you choose to use.
6. Licenses and Seat-Based Use
AI PowerKit is licensed on a per-user basis. When you purchase a license, you acquire a
non-exclusive, non-transferable, revocable right to use the Toolkit as described in these Terms.
License types may include:
-
Individual License: one seat assigned to one natural person (a consultant,
project manager, etc.). The Licensee may use AI PowerKit across multiple projects and clients,
but only for their own personal use. -
Team License: a multi-seat license covering a specified number of users
within the same organisation or department. Each user must have their own account and is
counted as a seat. -
Enterprise License: a customised license governed by specific terms agreed
in writing between your organisation and the Toolkit provider.
"One user = one seat" means:
- each person using the Toolkit must be covered by a valid seat on a valid license, and
- sharing a single-seat license between multiple individuals is not permitted.
7. License Keys and Verification
After purchasing AI PowerKit (for example via Gumroad or another authorised platform), you will
receive a license key. This key:
- identifies your license type and seat allocation,
- is used to activate your access on powerkitpm.com or equivalent portal, and
- may be checked on the public License Verification page to confirm its status.
You agree to:
- keep your license key confidential,
- not share your key publicly or with unauthorised persons, and
- notify us if you suspect any misuse or compromise of your key.
8. Permitted and Prohibited Uses
Subject to these Terms, you may:
- use the Toolkit for your own internal professional work,
- adapt and modify the templates for your projects and clients, and
- deliver final, customised documents to your clients as part of your services.
You may not:
-
resell, redistribute or repackage the Toolkit itself, in whole or in part, as "templates",
"frameworks" or similar products to third parties; - share the original files or lightly modified versions as a standalone product or toolkit;
- claim the Toolkit itself as your own original product or intellectual property;
- bypass or attempt to bypass any technical or seat-based limitations of the licensing system.
9. Payments, Delivery and Updates
Payments for AI PowerKit are processed via third-party platforms such as Gumroad or similar
providers. By purchasing the Toolkit, you also agree to the terms and conditions of the payment
platform handling the transaction.
Once payment is confirmed:
- you will receive access to your license key, and
- you will be able to download the current version of the Toolkit and any updates included
in your license period (for example, 12 months).
After the included update period expires, you may continue to use your existing version of the
Toolkit under the same license terms. Access to future updates may require purchasing a new
license or an extension, if and when such options are offered.
10. No Guarantee of Results
AI PowerKit does not guarantee any specific outcome, including but not limited to:
- winning contracts or tenders,
- approval from authorities or regulators,
- profitability, cost savings or improved performance,
- compliance with any specific regulation, standard or code.
Your results depend on many factors outside the Toolkit’s control, including your experience,
judgment, data quality, project context and the way you customise and apply the Toolkit.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the provider of AI PowerKit shall not be
liable for any:
- indirect, incidental, special or consequential damages,
- loss of profits, revenue, contracts, data or goodwill, or
- claims by third parties arising from your use of the Toolkit or your final documents.
In all cases, the total aggregate liability of the provider, whether in contract, tort or
otherwise, shall be limited to the amount actually paid by you for your current license of
AI PowerKit.
12. Customer’s Duty to Verify and Correct
You explicitly acknowledge that AI PowerKit delivers materials in an initial or
intermediate draft stage. It is your duty to:
- verify all content,
- correct errors or omissions,
- adapt the structure to match your internal procedures and contractual obligations,
- ensure that the final deliverables are accurate, appropriate and compliant.
The Toolkit is a starting point, not a finished product ready for submission or signature.
13. Intellectual Property
All intellectual property rights in and to AI PowerKit (including but not limited to structures,
layouts, wording, design and branding) remain with the Toolkit provider or its licensors.
You receive a license to use the Toolkit under these Terms; you do not acquire ownership of
the intellectual property in the Toolkit itself.
14. Term, Suspension and Termination
Your license is valid as long as:
- you comply with these Terms, and
- your license has not been revoked or terminated for misuse, non-payment or other material breach.
The provider reserves the right to suspend or terminate your license and/or access to updates
if you:
- violate these Terms, including licensing and redistribution rules, or
- engage in fraudulent, abusive or harmful behaviour related to the Toolkit.
15. Changes to the Toolkit and to These Terms
The Toolkit may evolve over time. Features, structures or modules may be added, modified or
discontinued. Where appropriate, changes will be communicated via the website or update
channels.
These Terms may also be updated from time to time. The current version will always be available
on the official website (for example, powerkitpm.com). Continued use of the Toolkit after
changes become effective constitutes your acceptance of the updated Terms.
